UGC - Terms of Service

1. Introduction

These Terms of Service govern how we interact with and use your content or likeness. We use a user-generator content tool named Pixlee Turnto, Emplifi  (Pixlee) to source and curate content from our Intrepid community when you use the hashtag of either “#Intrepid”, #BeIntrepid or “#IntrepidTravel” or tag Intrepid Travel when uploading content to Instagram, TikTok, Facebook, Twitter, Pinterest and LinkedIn (Channels). In some cases, we also communicate directly via the Channels to obtain permission to use your content or likeness in accordance with these Terms of Service.

When we refer to content, we mean any text, images, photographs, audio, video and other material such as your user profile data which may include your name and details displayed or made available on the Channels (Content). When we refer to likeness, we mean your name, nickname, social media profile, voice, likeness, image, and any other means by which you may be recognised (Likeness).

2. Acceptance of Terms of Service

Please carefully read these Terms of Service, along with any other terms and policies referenced herein as they constitute a legally binding agreement which governs our access to, and our use of, your Content and your Likeness.

When you reply to our direct message across the Channels with #YesIntrepid you confirm that you understand you are giving us permission to the Publication of your Content and your Likeness, and that you have granted us a non-exclusive, perpetual, irrevocable license to use your Content and Likeness in this way and that you agree to be bound by these Terms of Service. By Publication, we mean any advertising (including paid advertisements), media publicity, publication, general display and for any other advertising purposes in whole or in part, including but not limited to publication on internet websites (including, but not limited to, the Channels), broadcasts and any other publications as released to or by Intrepid (Publication).

We reserve the right to use, not use, or discontinue using any Content or use of your Likeness at our sole discretion at any time.

3. Privacy Policy

​Intrepid takes its data protection and privacy responsibilities seriously.

If you provide us with consent to use your Content or Likeness, we will collect your email address to ask any follow up questions or let you know when your Content or Likeness is shared on Intrepid’s Channels.

Accordingly, please read our Privacy Policy to understand how we use and protect the personal information you provide us, or we receive and collect when you use our services such as Pixlee, including how we collect it, and what we do with it, as well as some of the steps we take to safeguard your personal information.

4. Copyright and Intellectual Property Rights

You represent and agree that you are solely responsible for your Content, and warrant its legality, originality and compliance with applicable copyright and intellectual property laws.

You agree that you will indemnify us from any claim arising from a breach by you of this warranty.

5. Moral Rights

You acknowledge that Intrepid may infringe your moral rights in your Content, including by not attributing your Content to you, by not identifying you as the author of your Content, and by editing or replicating your Content for Publication. You consent to these infringements and agree that you will not bring any legal action against Intrepid for infringement of moral rights in your Content or Likeness.

6. Permission of any persons

You warrant that you have the express written permission of all other people appearing in the Content and their permission to have their likeness and name used by us. You confirm that you have provided any other person appearing in the Content a copy of these Terms of Service.

You confirm that no one under the age of 18 years old appears in your Content, or if any people in your Content are under the age of 18 years old, you confirm that you have obtained express written permission from a parent or guardian to have their likeness used by us.

7. Definitions

We are part of a wide group of companies and references to “Intrepid”, “Intrepid Group”, “we”, “our” and “us” means Intrepid Group Pty Limited and each of our affiliates, related bodies corporate and branded partners forming part of our group, including but not limited to Intrepid, Urban Adventures, Wildlands Trekking, Haka Tours and ANZ Nature Tours.
